MCD are suing Boards.ie
Previously on Globaleyes, we had reported the story of how MCD (McCann and Desmond) Promotions were attempting to silence certain sections of the Irish media over reports of violence and intimidation at the recent Oxegen festival in Ireland. One of the groups that they had attempted to cow into silence was the discussion forum boards.ie - a not-for-profit discussion forum, run and administered by a group of dedicated posters who work for free: because they believe in free discussion.
And now, readers dear, it appears that MCD were not contented with having threatened boards.ie into silence but have now decided to sue them.
From boards.ie this morning:
'As of Friday, 11th August 2006, MCD Productions have entered into legal proceedings against boards.ie Ltd.
At this time we cannot make, or allow, comment on an ongoing legal action against Boards.ie. Please understand and accept that we cannot enter into public debate or discussion about it.'
It's difficult to begin describing how idiotic this is. Evidently MCD are in the grasp of total panic and have decided that rather than addressing the very serious concerns raised in the Irish Independent piece of July 24th they have instead decided to threaten an organisation with no money, no formal employees and no method of defending itself. Make no mistake: their actions will now guarantee that this story will be in view of every potential ticket-buyer in Ireland within the next 24 hours.
Do MCD not realise the scale of the potential backlash that they are facing?

It might make sense for MCD to take a look at the demographics of the average user of an internet forum before continuing legal action. I'd imagine there's quite a corrolation to that of their customer base.

Boards.ie ceeding to pressure from MCD is pathetic.There is no way MCD would risk making the story nationwide/Tabloid fodder by shutting down the whole site through the legal system. Surely they are just facilitating freedom of speech by allowing punters to give their opinions.
I worked on the event and was leaving at around 6 on the Sunday when a group of around 5 lads started hassling me for the wrist bands I had, "stupid scabby c*nt" etc. It was nt that bad but they were hammered and basically looking for any way to get in.They sarted scaling the walls telling the one security guard to "fuck off".
Point is MCD will keep making Oxegen bigger and badder untill it starts to implode, which could be now. Boards.ie could have really launched themselves with this.

Well, MCD aren't like a shop or a brand you can easily boycott. If you want to go see a band, often, you can only see them at a show MCD are promoting.
The bad sentinment they are cultivating is hard to convert into a direct loss of revenue for them in many cases.
Though in the long-term, it's never a good busines move to alienate your customers like this, because it means as soon as they can jump ship, they will, and eagerly.

This is absolutely ridiculous. What needs to be done is that everybody who was in anyway injured or traumatised by what happened at oxegen needs to start cases against MCD? These pricks need to be put in their place.

Thanks for the link to mcd's feedback page. I just sent them this;
Your action against boards.ie is a pathetic attempt at bullying a community forum, which is largely made up of your biggest customer base, young, fairly well-off professionals and teenagers. It is both stupid and aggressive.
I am writing this to inform you that to me this is the final straw. I have long disliked many of your company's methods and business practices and will no longer be attending any of your events. Instead I will be heading to the UK for any concerts I wish to see. Your company generally over-charges to such an extent that it usually works out cheaper for me to fly to gigs in London anyway. And I am not the only one who feels this way, a large number of my social group has also come to the same conclusion.
Instead of being smart and using a service like boards to monitor what many of your customers have to say about your events, and using it as free market research, to help improve your business you have resorted to cheap bullying tactics which will backfire. Just do a google search on the words "mcd + boards.ie" It is also worth mentioning that boards has over 60,000 users, all who are now aware of your legal action.
And just so you know, I am a 27 year old married homeowner. Childless and with a bloody large disposable income. Congratulations on losing my custom.

boards.ie need to get their house in order. if they want to run a public forum where they tell all users that they do NOT have the right of free speech (check their FAQ) then this is precisely what will happen. Many of the moderators are jumped up little hitlers who hide behind an email address and moderator "privileges".
MCD on the other hand lost my custom many years ago. I didn't need to be told.. I figured it out for myself.

You or the press don’t have many “free speech” rights in Ireland. One of many reasons is that defamation law here is biased in the favour of the person/group who is been defamed.

Simon Bradish - I like your email, but threatening to fly to London to go to gigs will just make them laugh. I'm not sure if you've seen it in the news over the last few months, but MCD have been slowly buying a massive stake in Mean Fiddler promotions in the UK, who are almost as difficult to avoid as MCD are here.

The structure of boards.ie is their own undoing, if they used a gtld like for example irishboards.com/net/org, they can have their WHOIS shielded from view (no one to sue), secondly host on international servers (just try and sue a russian hosting company,etc), most of these guys would laugh at a legal threat from a small irish music promoter, it is because a cctld like the ie domain is a source of personally identifiable information and being hosted locally makes them vulnerable. I know because I practice what I preach.
